Job Summary:
The Property Management Legal Counsel is responsible for providing legal guidance and support to the property management team in all matters related to real estate and property management. This role involves ensuring compliance with applicable laws and regulations, managing legal risks, and protecting the organization's interests in property management operations. The Property Management Legal Counsel works closely with internal stakeholders, including property managers, executives, and external legal advisors, to ensure legal compliance and mitigate potential legal issues.
Key Responsibilities:
1. Provide legal advice and support to the property management team on a wide range of legal matters, including but not limited to leasing agreements, contracts, property acquisitions and dispositions, landlord-tenant disputes, and property-related litigation.
2. Review and draft legal documents, including leases, contracts, and various agreements, to protect the organization's interests and ensure compliance with applicable laws and regulations.
3. Conduct legal research and analysis to stay updated on relevant laws and regulations affecting the property management industry, and advise on potential legal risks and implications.
4. Collaborate with property managers and other stakeholders to develop and implement policies, procedures, and practices that align with legal requirements and best practices in property management.
5. Advise on legal implications of property management decisions, including property maintenance, tenant relations, rent collection, and evictions, ensuring compliance with applicable laws and regulations.
6. Represent the organization in legal proceedings, negotiations, and settlements related to property management, including court appearances, mediations, and arbitrations.
7. Collaborate with external legal advisors and coordinate legal matters to ensure efficient resolution of legal issues.
8. Assist in the development and delivery of training programs to educate property management staff on legal compliance and risk management.
9. Maintain accurate and organized legal records, contracts, and documentation related to property management activities.
Qualifications and Skills:
1. Juris Doctor (JD) degree from an accredited law school.
2. Active license to practice law in the state/jurisdiction where the organization operates.
3. Minimum of 5 years of experience practicing law with a focus on real estate, property management, or related fields.
4. In-depth knowledge of real estate laws, property management regulations, and landlord-tenant laws.
5. Strong understanding of contract law and experience in drafting and reviewing legal documents.
6. Excellent analytical and problem-solving skills, with the ability to apply legal principles to practical situations.
7. Strong negotiation and conflict resolution skills, with the ability to handle disputes and legal issues effectively.
8. Strong written and verbal communication skills, with the ability to communicate complex legal concepts to non-legal stakeholders.
9. Ability to work independently and collaboratively in a fast-paced environment, managing multiple priorities and deadlines.
10. Attention to detail and strong organizational skills, with the ability to maintain accurate legal records and documentation.
11. Professional demeanor and ability to maintain confidentiality.
12. Proficiency in using legal research tools and software.
